Amicus Curiae Briefs Filed
State of Florida v. Guadalupe Moreno, Miami-Dade County Court Case No. 375690-W (1997). Amicus curiae (friend of the court) brief filed in Miami-Dade County Court on behalf of the Florida Association of Criminal Defense Lawyers-Miami. This case was a "test case" in the State Attorney's efforts to preclude meaningful cross-examination and argument concerning the validity of breath tests.
Williams v. State of Florida, Third DCA Case No. 95-02476. Amicus curiae (friend of the court) brief filed on behalf of the Florida Association of Criminal Defense Lawyers-Miami in Florida's Third District Court of Appeals attacking the implementation of a system which allows police officers to testify as "drug recognition experts" in driving under the influence cases.
Orlando Garcia, et al. v. State of Florida, Third DCA Case No. 93-678. Amicus curiae brief filed on behalf of the American Civil Liberties Union of Florida and the Florida Association of Criminal Defense Lawyers-Miami, in Florida's Third District Court of Appeals concerning the purposeful and systematic destruction of exculpatory videotape evidence in driving under the influence cases.
Essen & Yates v. Mellon, Case No. 90-2243-CIV-MORENO. Amicus curiae brief filed in United States Federal Court for the Southern District of Florida on behalf of the National Association of Criminal Defense Lawyers, the Florida Association of Criminal Defense Lawyers, and the Florida Association of Criminal Defense Lawyers-Miami, concerning the implementation of an administrative system which punishes those accused of driving under the influence by suspending their driving privileges before trial.
